10.06.2025 sb C.R.M. (NDPS) 413 of 2025 In Re:- An application for bail under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, filed in connection with Kharagpur GRPS Case no. 33 dated 24.2.2024 under Sections 20(b)(ii)(c)/29 of the NDPS Act, 1985.

Nasim Ali Ms. Parna Roy Ms. Nargish Parveen ...for the Petitioner Mr. Joydeep Biswas Mr. Aritra Bhattacharya ...for the State It is submitted on behalf of the petitioner that he is in custody for about one year four months and that 62.95 kgs. of Ganja were allegedly recovered from the possession of the four accused persons including the present petitioner. However, the prosecution intends to examine fourteen witnesses out of which they could examine so far only four witnesses and nobody knows how long it will take to conclude the trial. He further submits that the petitioner has no criminal antecedent and if he is released on bail, he will appear before the court as and when required.

Learned counsel for the State raised objection contending that on 14/15th May, 2025, four witnesses were examined and it will not take much time to conclude the trial and if at this stage, the accused is released on bail, there is

every chance of his absconsion, which will get the trial delayed.

Having considered the submissions made on behalf of both the parties and that rigour of Section 37 of the NDPS Act clearly attracts in the present case against the present petitioner, the prayer for bail is rejected.

Accordingly, CRM (NDPS) 413 of 2025 is disposed of. Urgent photostat certified copy of this order, if applied for, be given to the parties upon compliance of all requisite formalities.
