Adil Badr Mr. M.A. Naskar ... for the State Learned counsel for the petitioner submits that the petitioner is not the principal accused in this case. There are case and counter case. Charge-sheet has been submitted.

Learned counsel for the State opposes the prayer for anticipatory bail and relies on the statements of the victim and the other witnesses, which implicate the present petitioner. He also relies on the injury report and other medical documents. The injury report of one of the victim shows fracture of nasal bone. It is alleged that the petitioner and others came in a group and attacked the other side, outraged modesty of women and assaulted the victims. Considering the above and the other incriminating materials available in the case diary, I do not consider this to be a fit case for granting anticipatory bail.

The application for anticipatory bail is, thus, rejected. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of requisite formalities.
