Learned advocate appearing for the petitioner prays for waiver of condition of bail, particularly the condition under Serial No. 3 in the order dated 30th April, 2015 wherein it was directed that the petitioner will not leave India without prior permission of the Court.

Learned advocate for the petitioner submits that petitioner had on 33 occasions left the country after seeking permission of the Court and has been diligent in complying with whatever conditions have been imposed upon him. Bail was granted 11 years ago and as such the said condition be waived.

Learned advocate for the CBI submits that the case could not proceed as one of the accused person is still absconding.

Having considered that one of the accused is still absconding, the whole condition cannot be waived at this stage. Learned Special Court would pass necessary orders when permission is sought for by the petitioner for going abroad as has been done on the earlier occasions. However, the said condition be waived after the charges are framed by the learned Special Court.

Accordingly, CRM (R) 33 of 2026 is disposed of. All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
