Dispute between two neighbours over illegal construction of a building has led both the parties to file complaint before the jurisdictional Police Station.

Police took up both the complaints for investigation. In respect of the complaint filed by the opposite party, Police has submitted charge sheet against the petitioner. Petitioner has approached this Court for quashing of the charge-sheet on the ground that no illegal construction was made by her and such construction was made by third party developers namely, one Dipankar Biswas, Samir Roy and Manoj Kumar Das.

Since charge-sheet has been filed, this Court is not inclined to pass any order in the instant revision at this stage.

However, the petitioner is given liberty to agitate all the points before the learned Magistrate at the time of consideration of charge by filing an application praying for discharge. The application filed by the petitioner in this regard shall be disposed of within one month from the date of communication of the order. The revision is, thus, disposed of.
