Mr. Arnab Mukherjee representing the appellant has submitted that he has entered appearance in this appeal duly authorized by the appellant after the death of learned Advocate Kollol Chowdhury. He has further submitted that the appellant is not willing to proceed with the appeal and has requested his junior Mrs. Rituparna Sil Sarkar to pray for withdrawal for the appeal. Mrs. Rituparna Sil Sarkar has also filed the voklatnma in court today and the same is accepted. In view thereof the appeal stands dismissed for non-prosecution. The connected application being CAN no.1 of 2010 also stands dismissed.
