Ms. Debanwita Pramanik Mr. Mahesh Lal Sharma ....for the petitioner Learned counsel appearing on behalf of the petitioner submits as follows. The petitioner had filed a complaint case under Section 138 of the NI Act in the year 2013. In 2020, the matter was disposed of for being premature. In 2020 itself a fresh complaint was filed by the petitioner. But, till date even the plea has not been taken. The proceeding has remained pending for no fault of the petitioner. As the petitioner has prayed for expeditious disposal of the proceeding, no prejudice will be caused to anyone, if a final order is passed without issuing a notice to other side. Although the initial complaint was filed in the year 2013, this is a fresh proceeding that was initiated in the year 2020.
However, there is a delay in concluding the proceeding in view of the stipulations as contained in the said Act in this regard. In view of the above, the learned trial Court is requested to conclude the proceeding in accordance with law and at the earliest keeping in mind the relevant stipulations contained in the said Act for expeditious hearing.
With these observations, the revisional application is disposed of.
