Constitutional Writ Jurisdiction (APPELLATE SIDE) WPA 7517 of 2026 Sankar Sanfui -Versus - The State of West Bengal & Others Mr. M.A. Naskar Mr. Sandip Kumar Mondal Ms. Ritika Yadav ......for the petitioner Mr. Akas Dutta ......for the State respondents

1) Affidavit of service filed on behalf of the petitioner is taken on record.

2) Petitioner prays for direction upon the concerned police authorities to take necessary steps in order to protect the right of the petitioner over the land in question which would facilitate the petitioner to cultivate the said land.

3) Learned advocate representing the State respondents has filed a communication dated 1st April, 2026 of Inspector-in-Charge of Baruipur Police Station, South 24 Parganas and same is taken on record. Copy of said communication is made over to the learned advocate representing the petitioner.

4) It is disclosed in said communication dated 1st April, 2026 that there are case and counter case in connection with the land in question. In connection with complaint lodged by the wife of the petitioner a criminal prosecution being Baruipur Police Station Case No. 1180/25 dated 15th June, 2025 was initiated under certain provisions of Bharatiya Nyaya Sanhita, 2023 and same was culminated into a charge-sheet being Baruipur Police Station Charge-Sheet No. 1091/25 dated 30th June, 2025. Based on the complaint of respondent no. 4 another criminal prosecution being Baruipur Police Station Case No. 1150/25 dated 13th June, 2025 was initiated under certain provisions of the Bharatiya Nyaya Sanhita, 2023 and after completion of investigation chargesheet was filed being Baruipur Police Station ChargeSheet No. 159/25 dated 31st August, 2025.

5) As it emanates from the communication dated 1st April, 2026 that charge-sheet has already been filed by the Investigating Officer in connection with the criminal prosecution which was initiated on the basis of the complaint lodged by the wife of the petitioner, no further order need be passed in this writ petition. However, police authorities are directed to maintain peace and tranquility at the locale and keep vigil.

6) Writ petition stands disposed of.

7) There shall be no order as to costs.

8) Urgent photostat certified copy of this order, if applied for, be given to the parties on usual undertaking.
