The allegation against the petitioner is that she instigated her son to shoot her mother. The motive attributed is that the family pension that her mother used to receive would go to the petitioner once the petitioner's mother dies. Learned Advocate for the petitioner says that this is an absurd theory. The petitioner being a married daughter would not get family pension that was payable to her father or mother.

Be that as it may, we have seen the material in the case diary. There are at least two eye-witnesses who clearly state that it was the petitioner who told his son to open fire on the victim. Considering the nature and gravity of the charge and the extent of complicity of the petitioner therein, although charge sheet may have been submitted, we are not inclined to entertain the petitioner's prayer for anticipatory bail.

CRM No. 2904 of 2021 is, thus, dismissed.
