1. In view of their good office being exercised by learned counsel for the parties, particularly, the Damodar Valley Corporation (DVC), the matter has been resolved amicably.

2. Learned counsel for the DVC, on instruction, submits that his client is agreeable to the increment of contract demand sought by the petitioners from May 01, 2024.

3. Learned counsel for the petitioners, in his usual fairness, agrees to such proposal, also on instruction.

4. Accordingly, WPA No. 7903 of 2024 is disposed of by directing the respondent no. 1-DVC to increase the contract demand of petitioner no. 1 from 7 MVA to 13 MVA as per the request of the petitioners on and from May 01, 2024.

5. It is made clear that the billing cycle shall be treated to commence on and from May 01, 2024. The charges shall also be levied by the DVC accordingly.

6. It is made clear that since affidavits have not been invited, it is deemed that none of the allegations made in the writ petition are admitted by the respondents.

7. There will be no order as to costs.

8. Urgent photostat certified copies of this order, if applied for, be made available to the parties upon compliance with the requisite formalities.
