1. The matter relates to the proposed construction of railway over bridge at Sainthia. The petitioners pray for consideration of the representation that is pending consideration at the end of the Senior Divisional Engineer (Co-ordination), Eastern Railway, Howrah Division, Howrah.

2. Learned advocate representing the State respondents submits that the plan has been approved by the Railway Authority as per the prescribed parameters. The Railway Authority is not represented.

3. Affidavit of service filed by the petitioners is taken on record. In the absence of any representation from the Railways it is not possible for the Court to decide the issue conclusively.

4. In view of the above, the instant writ petition is disposed of by directing the Senior Divisional

Engineer (Co-ordination), Eastern Railway, Howrah Division, Howrah, respondent no. 2A herein, to consider and dispose of the representation filed by the petitioners in accordance with law after affording opportunity of hearing to one of the representatives of the petitioners and to all other necessary authorities at the earliest, but positively within a period of six weeks from the date of communication of this order.

5. Prior notice of hearing shall be provided to the petitioners and all other necessary authorities. Reasoned order shall be passed and communicated to the parties immediately thereafter.

6. Learned advocate of the petitioners is directed to forward a copy of the representation along with all other supporting documents to the aforesaid respondent at the time of communicating the order of the Court.

7. It is made clear that this Court has not gone into the merits of the claims of the petitioners and all points are left open to be decided by the respondents at the time of consideration of the representation.

8. The writ petition is disposed of.

9. Urgent certified website copy of the order, if applied for, be given to the parties on compliance of requisite formalities.
