The grievance of the petitioner pertains to illegal and unauthorised construction on public land/Khas Mahal land.

It is submitted on behalf of the petitioner that the private respondents are carrying on with unauthorised and illegal construction on public land and no steps have been taken by the respondent authorities.

Mr. De appears for the State respondents and submits that the representation of the petitioner be sent to the concerned District Magistrate for consideration.

In view of the submissions made on behalf of the parties, the District Magistrate being the respondent no.2 is directed to consider the representation of the petitioner appearing at Annexure P/3 page 38 of the

petition within a period of two months from date after giving a right of hearing to all the affected parties. I make it clear that I have not gone into the merits of the case and the District Magistrate the respondent no.2, in considering the representation of the petitioner, will not be bound by any observation or finding made in this order.

With the aforesaid directions, WPA 8228 of 2021 is disposed off.
