1. We have heard learned counsel for the respective parties elaborately.

2. In the light of the reasons given in support of the application being CAN 1 of 2024, the application is allowed and disposed of and the writ petition is restored to its original file and number.

3. The writ petition has been filed challenging the appointment of the private respondent who has been authorized to exercise powers and perform the duties of the Vice Chancellor in the West Bengal University of Animal & Fisheries, Government of West Bengal. Identical orders were passed by His Excellency, the Chancellor, the Governor of West Bengal which was challenged before this Court and the same was upheld. In the said order the Court had considered what was the role of a person who is authorized to discharge the duties of a Vice Chancellor. The said decision is in the case of Sanat Kr. Ghosh vs. the

Chancellor, University of Kalyani reported in (2023) Labour & Industrial Cases, 2801.

4. Hence, following the said decision, the writ petition stands dismissed.
