Learned Counsel for the petitioner submits he is in custody for 79 days. It is also submitted he has been falsely implicated. There is no possibility of trial commencing in the near future as prayer for further investigation has been made by the de facto complainant. He prays for bail.

Learned Counsel for the State opposes the bail prayer.

Learned Counsel for the de facto complainant submits prayer for further investigation has also been made on behalf of the State.

We have considered the materials on record.

Petitioner is in custody for 79 days. Whether the allegation of Signed By :

sexual assault is credible requires to be assessed during trial. However, prosecution as well as the de facto complainant have prayed for further investigation. There is no possibility of trial commencing in the near future. There is also no chance of abscondence. Under such circumstances, we are inclined to grant bail to the petitioner.

Accordingly, we direct that the petitioner shall be released on bail upon furnishing a bond of Rs.10,000/- with two sureties of like amount each, one of whom must be local, to the satisfaction of the learned Additional Sessions Judge, 2nd Courtcum-learned Judge, Special Court under POCSO Act, Purba Bardhaman, subject to conditions that petitioner shall appear before the trial court on every date of hearing until further orders and shall not intimidate the witnesses and/or tamper with evidence in any manner whatsoever.

6. In the event the petitioner fails to appear before the trial court without justifiable cause, the trial court shall be at liberty to cancel his bail in accordance with law without further reference to this Court.
