1. Sufficient grounds are available to explain the absence of the petitioner and/or his Counsel on 25th January, 2023 before this Court.

2. The said order is recalled and the writ petition is restored to its file and number.

3. Accordingly, CAN 5 of 2023 is disposed of.

4. There will be, however, no order as to costs. Re: R.V.W. No. 54 of 2023

1. Review is sought of the order dated 9th February, 2023 passed by this Court on the ground that in an earlier order in the writ petition this Court had called for an enquiry report of the Director General and Inspector General of Police.

2. Such report was not felt necessary for disposal of the writ petition on 9th February, 2023 since the

Inspector-in-charge, Manikchak Police Station had already filed a report dated 8th February, 2023.

3. This Court was satisfied with the report of the Manikchak Police Station.

4. The question of review of the order dated 9th February, 2023 even for the purpose of directing furnishing of any report from Director General and Inspector General of Police to the petitioner does not and cannot arise.

5. The report was sought for satisfaction of the Court and the petitioner cannot claim any right thereto before this Court. If the petitioner is otherwise entitled to the same under any law, he may take appropriate steps in that regard.

6. In view of the above, R.V.W. No. 54 of 2023 shall stand dismissed.

7. There will be no order as to costs.

8. All parties are directed to act on a server copy of this order duly downloaded from the official website of this Court.
