Learned advocate appearing for the petitioner submits petitioner is in custody for 1 year and 10 months. Out of 19 witnesses cited by the prosecution, 13 witnesses have already been examined. The petitioner earlier approached this Court at the initial stage.

It has also been submitted that petitioner is similarly placed as another accused namely, Lal Mohan Kamila @ Lalu @ Lalmohan Kamila.

Learned advocate for the State prays for some time to complete rest of the witnesses.

Since few more witnesses are to be examined by the Prosecution, I direct the learned Trial Court that if within a period of 6 months rest of the prosecution witnesses are not completed, in spite of co-operation extended by the present petitioner, learned Trial Court will release the petitioner on bail. It is further reiterated that the trial of the case would continue in spite of any resolution of the local bar and no adjournment be granted to any of the parties without the Court being satisfied that there are exceptional circumstances to adjourn the matter.

At this stage, the prayer for bail of the petitioner is refused. However, learned Trial Court would abide by the directions passed above.

Thus CRM (M) 839 of 2026 is dismissed.
