1. Heard the learned counsels for the parties.

2. On perusal of the materials on record, it appears that the petitioners have challenged the vires of the Employees'

Pension Scheme Amendment Act 2014, to the extent which restricts contribution to pension fund to monthly salary slip of Rs.15,000/-.

3. The petitioner in the present writ application was willing to contribute at a higher rate in order to claim a higher pension.

4. While the present writ application was sub judice, the Hon'ble Supreme Court passed the judgment in EPFO

vs. Sunil Kumar B. (2022) 12 SCC 701, deciding the issue.

5. Accordingly, the status of the present writ application has now shifted and the writ application is thus disposed of with liberty granted to the petitioner to pray before the appropriate authority for relief as granted by the Supreme Court in Sunil Kumar B. (supra) and the appropriate authority shall consider the same, in accordance with law, expeditiously.

6. The writ application stands disposed of.

7. Connected application, if any, stands disposed of.

8. Urgent Photostat certified copy of this order, if applied for, be supplied to the parties upon complicane with all requisite formalities.
