The civil revision has been preferred praying for transfer of Misc.Case No.44 of 2025, under Order Rule CPC, arising out of Matrimonial Suit No.1728 of 2023 pending before the Learned Court of Additional District Judge, 3rd Court at Barackpore, District-24 Parganas (North) to the Learned Court of District Judge, Berhampore, DistrictMurshidabad.

Admittedly, the matrimonial suit being instituted by the husband/opposite party herein has been decreed ex parte.

Misc.Case sought to be transferred is an application praying for setting aside the ex parte decree.

Considering the technical difficulties and away from the place, where the suit has been decreed, this court is not inclined to transfer the Misc.Case, in the interest of justice.

Accordingly, the revisional application is disposed of with the direction that the Learned Trial Court being the Learned Additional District Judge, 3rd Court, at Barrackpore, shall make all endeavour to dispose of the Misc.Case expeditiously, preferably within 60 (Sixty) days from the date of the communication of this order.

The civil revision stands disposed of.

Applications, if any, connected thereto stand disposed of consequently.

9.

Interim order, if any, stands vacated.

10. Photostat certified copy of this order, if applied for, be given to the parties on priority basis upon compliance of all formalities.
