No. 29 CHC Rejected C.R.M.(A) 1275 of 2023 In Re:- An application for anticipatory bail under Section 438 of the Code of Criminal Procedure in connection with Tehatta Police Station Case No. 507 of 2022 dated 21.06.2022 under Sections 22(c)/25/28/29 of the Narcotic Drugs and Psychotropic Substance Act.

And In the matter of : Suja @ Sujauddin Mondal @ Ainul Haque ...... petitioner Md. G. N. Imrohi ....for the petitioner Mr. Sanjoy Bardhan, Ms. Baishakhi Chatterjee ....for the State There are call details recording between the petitioner and the co-accused. Commercial quantity of narcotics were seized in the raid.

Petitioner apparently paid for commercial quantity of narcotics to the persons from whom the narcotics were recovered.

In such circumstances, we are of the view that petitioner is unable to overcome the restrictions under Section 37 of the NDPS Act, 1985.

Consequently, we are unable to grant anticipatory bail to the petitioner.

CRM (A) 1275 is rejected.
