16.09.2022 rc/ct.no.10 Item No.43 WPA No. 6930 of 2022 Mr. Prosenjit Mukherjee Ms. Tiyasa Ghosh ...for the petitioner Mr. Ashim Kumar Ganguly Mr. Sudip Sarkar ...for the State Pursuant to the order passed on 11.08.2022, learned counsel for the State-respondents submits, on instruction, that the concerned authority being the 4th respondent shall reconsider the prayer of the petitioner in the light of the judgment passed by a coordinate Bench of this Court on 21.04.2015 in W.P.No.5651(W) of 2011. In view of the same the order impugned dated 17.02.2022 is set aside.

The 4th respondent is directed to reconsider the prayer of the petitioner in the light of the judgment referred to above within two months from the date of communication of this order after affording reasonable opportunity of hearing to all the affected parties including the petitioners, in accordance with law.

Since nothing further remains to be adjudicated in the present writ petition, the writ petition is disposed of without any order as to costs.
