CRM No.2568 of 2018 with CRAN No.2 of 2020 (Old CRAN No.965 of 2020) (Via video conference) 07.09.21 (S.R.) Sl.09 Ct.30 In Re: An application for relaxation of condition of bail. And In re: Papai Ghosh ... petitioner.

Mr. Mritunjay Chatterjee Md. G.N. Imrohi Mr. Debapriya Majumder ... for the petitioner.

Mr. Tanmoy Kr. Ghosh Mr. A. Sen ... for the State.

The present application has been preferred praying for relaxation of the conditions of bail, as incorporated in the order dated 14th May, 2018 passed in CRM No.2568 of 2018. Mr. Imrohi, learned advocate appearing for the petitioner submits that the petitioner has complied with all the conditions, as incorporated in the order dated 14th May, 2020. He is the sole earning member and has a family consisting of his parents, wife and a fiveyear old child. He is not in a position to look after his family since he has been directed not to enter into the jurisdiction of Berhampore Police Station.

Mr. Sen, learned advocate enters appearance on behalf of the State and files a report and submits that out of twelve witnesses, seven witnesses, including the victim, have been examined. Let the report, as filed, be kept on record.

Heard the learned advocates appearing for the respective parties and considered the materials on records. It appears that the trial is at an advanced stage. There is also no adverse report against the petitioner.

In view thereof, the condition, as incorporated in the order dated 14th May, 2018 to the effect that 'the petitioner shall not enter the jurisdiction of Berhampore Police Station', is waived. The other conditions shall remain unaltered.

The application being CRAN No.2 of 2020 (Old CRAN No.965 of 2020) is, accordingly, disposed of.

All parties shall act on the server copies of this order duly downloaded from the official website of this Court. (Rabindranath Samanta, J.) (Tapabrata Chakraborty, J.)
