Learned advocate on behalf of the petitioner/ plaintiff has submitted that the injunction application was filed in September, 2022 and that application is still pending and the defendant sought for adjournment on different occasions for filing written objection. Considering the facts and circumstances, I do not find any reason to ask the petitioner to serve notice upon the opposite parties. Thus, service of notice upon the opposite parties stands dispensed with.

Accordingly, learned Civil Judge (Junior Division), 1st Court, Barasat, North 24-Parganas, is requested to dispose of the injunction application under Order XXXIX Rules 1 and 2 read with Section 151 of the Code of Civil Procedure in connection with Title Suit No.1019 of 2022,

within six weeks from the date of receipt of this order, without giving any unnecessary adjournment to any of the parties.

With the aforesaid observation, the revisional application, being CO 961 of 2023, stands disposed of. Learned advocate appearing on behalf of the petitioner is at liberty to bring this order to the notice of the learned Civil Judge (Junior Division), 1st Court, Barasat, North 24-Parganas, forthwith.

All parties shall act on the basis of a server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copy of this order, if applied for, be given to the parties, upon compliance of necessary formalities.
