Mijanur Midda Mr. Manas Kumas Das Mr. Aritra Kumar Thokdar Mr. Probal Das ...for the Petitioner This is an application wherein the petitioner has prayed for direction upon the court below for expeditious disposal of Misc. case no. 212 of 2023 under Section 125 of the Code of Criminal Procedure, presently pending before the learned Additional Chief Judicial Magistrate, Kalna. Being aggrieved by the long pendency of the proceeding, learned counsel for the petitioner submits that the petitioner filed an application under Section 125 of the Code of Criminal Procedure being Misc. case no. 212 of 2023 on 1st November, 2023 but the examination of witness has not yet been started and for which, the wife/petitioner is suffering a lot and therefore, she prays for necessary direction.

Having heard learned counsel for the petitioner, it appears that the prayer made by the petitioner is innocuous and if it is allowed in terms of the prayer made therein, the opposite party will have no cause to prejudice and as such, the service of copy of application upon the opposite party is hereby dispensed with.

In view of the aforesaid prayer made by the petitioner which is justified as well as required to be allowed for securing ends of justice, the instant application being CRR 1403 of 2026 is hereby disposed of with a direction upon the court below to make every endeavour for expeditious disposal of the aforesaid Misc. case no. 212 of 2023 and to make best effort to conclude the entire proceeding preferably within a period of six months from the next date of hearing.

This order is passed invoking this court's jurisdiction under Section 529 of the BNSS.
