The petitioner is aggrieved by the alleged inaction on the part of the Burtolla Police Station in respect of a complaint of an incident occurred on 26th December 2021 and complaint was lodged on 27th December 2021.

Mr. Amitesh Banerjee, learned counsel for the State submits that the private respondents have also filed a counter complaint against the petitioner and two FIRs have been registered by the Burtolla Police at the instance of the petitioner and against him.

It is ordered that the investigation into the two FIRs being Nos.214 of 2021 dated 27th December 2021 and 215 of 2021 dated 27th December 2021 be completed mandatorily and positively within a period of six weeks from date.

The statements of the concerned persons under Section 164 of the CrPC must be recorded. Any other medical documents that may be produced by the parties shall also be taken into account.

The petitioner shall hand over all documents to the Burtolla Police within a period of one week from date.

Final report shall be filed before the jurisdictional magistrate within the period stipulated hereinabove.

In the event, the petitioner is not satisfied with the final report, appropriate steps may be taken in accordance with the CrPC.

With the aforesaid directions, the writ petition is disposed of.

There shall be no order as to costs.

All parties shall act on the server copy of this order duly downloaded from the official website of this Court.
