1. None appears for the appellant.

No accommodation is prayed for.

2. At the instance of the writ petitioner/respondent the matter has been listed. Notice has been served upon the learned advocate for the appellant. Despite service of such notice, the learned advocate for the appellant does not appear.

3. This matter was filed upon obtaining leave of the court on the ground of urgency. On the last occasion, the matter was directed to go out of list.

4. The appeal arises out of an order passed by a learned Single Judge directing implementation of the decision of the municipal authority to demolish the unauthorized construction.

5. Mr. Dutta, learned advocate for the writ petitioner/respondent, submits that the appeal is not being moved by the appellant/person responsible for unauthorized construction but adjournments are being prayed for before the municipality whenever the municipality attempts to implement the order. It is also submitted that a statutory appeal has been filed before the civil court.

6. We are not inclined to go into the discussions on merits but as we find that the appellant is not interested to move the matter. Let the appeal and the application be dismissed for default. The interim order, if any, stands vacated.
