Mr. Arindam Jana Mr. Yuvraj Chatterjee Mr. Rahul Surtani ...for the petitioner Mr. Suman De Mr. Anindya Sundar Chatterjee ...for the State During the course of submissions learned Counsel for the petitioner submits that the charge-sheet in the present case has been filed in 2016 without arrest of the petitioner. Learned Counsel also submits that out of 20 charge-sheeted accused persons 18 are on prearrest bail. Learned Counsel has very fairly submitted that the present petitioner had not moved before the learned Trial Court. Learned Public Prosecutor submits that the charge-sheet was filed against the petitioner showing him absconding. The Court considers that since the charge-sheet was filed in 2016 without arrest and it is already pending consideration before the learned Trial Court, the petitioner herein should move an appropriate application before the learned Trial Court.

Learned Trial Court is directed to consider and decide the same in accordance with the law expeditiously. It is also pertinent to mention here that this Court has not gone into the merits of the case and no

expression made herein shall tantamount to be an expression on the merits of the case.

It is further directed that till such application having been moved by the petitioner is disposed of no coercive action shall be taken against the petitioner.

Accordingly, CRM(A) 1082 of 2025 stands disposed of. (Dinesh Kumar Sharma, J.)
