Matter relates to transfer of the petitioner since petitioner is suffering from ailments and in support of same, a medical report dated 15th September, 2022, which is at page 30 of the writ petition, is relied upon.

On perusal of the medical report dated 15th September, 2022, it appears that petitioner is suffering from 'Retinitis Pigmentosa' and at the material point of time disability of the petitioner was assessed to the extent of 100 per cent.

Petitioner made an application for transfer on

'Utsashree Portal' on 3rd August, 2021 and same was forwarded by the school authority where petitioner is working to the District Inspector of School (S.E.) concerned for further steps. After processing the transfer application, concerned District Inspector of School (S.E.) forwarded the transfer application of the petitioner along with medical report to the West Bengal Central School Service Commission (WBCSSC) through portal on 18th August, 2021. Grievance of the petitioner is till date transfer application of the petitioner is not decided.

Respondents are represented by learned advocates who have jointly submitted due to suspension of portal from 29th September, 2022 contemporaneous decision could not be taken on transfer application of the petitioner.

However, it is submitted on behalf of WBCSSC if concerned authority is directed transfer application of the petitioner shall be decided in accordance with law.

Having considered the respective submissions made on behalf of the parties, writ petition stands disposed of directing Chairman, WBCSSC to decide the transfer application of the petitioner by six weeks from the date of communication of this order and the decision to be taken by the Chairman, WBCSSC shall be

communicated to the petitioner by ten days thereafter.

It is made clear that suspension of 'Utsashree' portal shall not be a ground to reject the transfer application of the petitioner.

Urgent Xerox certified copy of this order be given to the parties expeditiously, if applied for, on usual undertakings.
