No. 29 KAUSHIK REJECTED C.R.M.(A) 1808 of 2022 In Re:- An application for anticipatory bail under Section 438 of the Code of Criminal Procedure in connection with Bongaon Police Station Case No. 208 of 2022 dated 26.02.2022 under Sections 326/120B of the Indian Penal Code, 1860 read with Sections 3/ 4 of the Explosive Substances Act, 1884.

And In Re : Ajit Adhikary ...... petitioner Mr. Susnigdho Bhattacharya ....for the petitioner Mr. Neiguive Ahmed Ms. Amita Gaur ....for the State Petitioner prays for anticipatory bail.

Learned advocate appearing for the petitioner submits that, no recovery was made from the possession of the petitioner. The petitioner was sought to be proceeded against on the basis of the statement of the co-accused made while in custody. The person from whom the explosive devises were recovered was enlarged on bail by the Jurisdictional Court. Learned advocate appearing for the State submits that, the petitioner is the main accused. There are criminal antecidents so far as the petitioner is concerned. Custodial interrogation of the petitioner is required in order to find out the

source from where the crude bombs were obtained and the person to whom they were made available to.

Considering the gravity of the offence and the involvement of the petitioner therein as transpiring from the materials in the case diary and considering the fact that there are at least three police cases against the petitioner, we are unable to enlarge the petitioner on anticipatory bail.

Accordingly, prayer for anticipatory bail of the petitioner is rejected and the application being CRM (A) 1808 of 2022 is dismissed.
