Grievance of the petitioner is in spite of death-in-harness of husband of the petitioner on 20th June, 2017 till date family pension case has not been settled in her favour.

It is submitted that after death of husband of the petitioner on 20th June, 2017 family pension case could not be settled since leave availed of by husband of the petitioner was not sanctioned. Today, during course of hearing, Mr. Das, learned advocate representing District Primary

School Council, South 24 Parganas has placed before this Court a memo dated 16th April, 2025 issued by the Chairman, District Primary School Council, South 24 Parganas by which leave has been sanctioned in connection with service rendered by husband of the petitioner as primary teacher. Copy of such leave sanctioning memo is taken on record.

Learned advocate representing District Inspector of Schools (PE), South 24 Parganas being respondent no. 4 has prayed for time to settle family pension case before forwarding the same to the Director of Pension, Provident Fund and Group Insurance being respondent no. 3.

In view of aforesaid submission made on behalf of the parties, writ petition stands disposed of directing respondent no. 4 to settle family pension case of the petitioner by fortnight from date of communication of this order and forward the same to respondent no. 3 by seven days thereafter. On receipt of papers from respondent no. 4, respondent no. 3 on compliance of necessary formalities shall issue Pension Payment order by fortnight thereafter. State respondents are directed to release terminal dues including family pension in favour of the petitioner at an early date but not later than

eight weeks from date of communication of this order.

There shall be, however, no order as to costs.

Urgent photostat certified copy of this order, if applied for, be given to the parties on usual undertaking.
