Petitioners Mr. Amal Krishna Samanta ...for the petitioners Mr. Anupam Das Adhikari Mr. Kaustav Banerjee ...for the State Learned counsel appearing on behalf of the petitioners submits as follows. The petitioners have been falsely implicated in this case. It is alleged that they had assaulted a police officer on duty. However, no grievous injury was caused to anyone.

Learned counsel appearing on behalf of the State strongly opposes the prayer for anticipatory bail. He relies on the statement of the victim and the statements of independent eye-witnesses. He also refers to the injury report, which shows injury inflicted on a vital part of the body.

It is alleged that the petitioners had accosted the victim and abused him with filthy language. Thereafter, they started beaten up him indiscriminately including with sticks on different parts of his body.

Considering the above and the other incriminating materials available in the case diary, I do not consider this is to be a fit case for granting anticipatory bail.

Accordingly, the application for anticipatory bail of the petitioners is rejected.
