-------- In Re : Application for Special Leave to Appeal under Section 378(3) of the Code of Criminal Procedure, filed on 10th May, 2018. This is an application under Section 378(3) of the Code of Criminal Procedure praying for Special Leave to Appeal against the judgment and order of acquittal dated 28th February, 2018 passed by the learned Additional Chief Judicial Magistrate, Kandi, Murshidabad in Case No. CR 317 of 2014. The application was filed in 2018. There were certain defects which were directed to be removed by an order dated 24th July, 2018. But the petitioner has not removed such defects. Today also the petitioner remains absent.

In view of such circumstances, this Court is of the opinion that the petitioner is not willing to proceed with the instant application.

Accordingly, the application for Special Leave to Appeal is rejected for non-prosecution.
