The grievance of the petitioner is directed against correction of land records by the respondent authorities.

The petitioner submits that notwithstanding death of the original lessee, the respondent authorities have failed to mutate the premises in favour of the petitioner.

The Asansol-Durgapur Development Authority being the respondent no.1 is represented and submits that notwithstanding several notices directing the petitioner to submit the probate of the Will of the original deceased lessee, the petitioner has been unable to produce such probate document before the respondent no.1.

The petitioner relies on the lease deed to substantiate that the Probate is not necessary for the petitioner to detain mutation.

I am of the view that the reliefs which the petitioner seeks are beyond the scope of the Writ Court. The remedy of the petitioner is to go before the respondent authorities and seek redressal of his grievance. There is no scope for the Writ Court issuing directions which the petitioner seeks for.

I find no merit in this writ petition.

Accordingly, WPA 8279 of 2021 is dismissed. However, there will be no order as to costs.

The petitioner is granted liberty to take necessary steps, if so advised, in accordance with law. The grievance, if any, with the respondent no.1 be considered in accordance with law.
