08/04/2026 D/L - 17 Court No.28 S. Kundu Partly Allowed C.R.M.(A) 1007 of 2026 In Re: An application for anticipatory bail under Section 482 of the BNSS, 2023. In connection with Manikchawk P.S case no. 424 of 2025 dated 11/06/2025 under sections 109/117(2)/118(2)/126(2)/3(5)/329(3) of the BNS.
In the matter of: Sekh Majed @ Sk. Majed & Ors.
...Petitioners.
Mr. Debayan Ghosh Ms. Poulami Bose ...for the petitioners.
Ms. Sukanya Bhattacharyya Mr. Pratick Bose ...for the State.
1. Report filed on behalf of the State is taken on record.
2. Learned counsel appearing on behalf of the petitioners submits as follows. There was a fight between two groups. Both sides suffered injuries. There is a case and counter case. No specific role has been attributed to the petitioner nos. 1 and 3. In fact, the petitioner no. 1 is 60% disabled, with one of his legs amputated below the knee.
3. Learned counsel appearing for the State relies on the case diary and opposes the prayer for anticipatory bail. She refers to the statements of witnesses and the injury report, which shows that at least two of the injured suffered serious cut injuries on the head requiring stitches for repair and one of the victims suffered fracture
injury on a finger. However, as per the report, the petitioner no. 1 does suffer from disability.
4. Considering the above and the other materials available in the case diary and the fact that the petitioner no. 1 suffers from serious disability, while I am inclined to grant anticipatory bail to the petitioner no. 1, the application for anticipatory bail of the petitioner nos. 2 and 3 is rejected.
5. In the event of arrest, the petitioner no. 1 shall be released on bail upon furnishing a bond of Rs.10,000/- each with two sureties of like amount each, one of whom must be local, to the satisfaction of the Arresting Officer and also be subject to further conditions that the said petitioner shall cooperate with the investigation and shall not threaten or intimidate the witnesses. The said petitioner shall meet the I.O as and when required.
6. Accordingly, the application for anticipatory bail is allowed-in-part.
7. Urgent photostat certified copy of this order, if applied for, be given to the parties upon compliance with requisite formalities.
