The petitioner is in custody in connection with Bagdah Police Station Case No.720 of 2021 dated 12th October, 2021 under Sections 21(C)/29 of the NDPS Act read with Section 14 of the Foreigners' Act
presently pending before the learned Additional Sessions Judge, 6th Court, Barasat.
It is submitted by the learned advocate for the petitioner that the case was committed to the Court of Sessions on 8th November, 2021. After a lapse of about one year the learned trial Judge framed charge against the accused who is in custody on 4th August, 2022. Thereafter out of nine charge sheeted witnesses only one witness has been examined. Next date for trial is fixed on 17th and 18th April, 2023. Under such circumstances, specially due to the reason that the petitioner is languishing in custody, the petitioner has prayed for expeditious disposal of the case.
This Court is of the view that the instant revision can be disposed of with the assistance of the learned P.P.-in-charge. Therefore, Ms. Sujata Das, learned advocate is requested to assist this Court on behalf of the State. Appearance of Ms. Sujata Das be regularized by the learned Legal Remembrancer, Government of West Bengal.
Having heard the learned advocates for the petitioner and the State and on perusal of the entire materials on record, I find that there are eight witnesses left to be examined by the learned trial Judge. The learned trial Judge is requested to take all possible step
for examination of the remaining charge sheeted witnesses within six months from the date of communication of this order. The instant revision is, thus, disposed of on contest. (Bibek Chaudhuri, J.)
