Learned advocate appearing for the petitioner submits that the petitioner has been implicated along with another for alleged recovery of 53 kgs. ganja from a vehicle. There were two other persons who were implicated as accused but the charge-sheet is silent on the same. However, the cognizance of the offence as well as the charges were framed without the chemical examiner's report and till date the chemical examiner's report has not been submitted and unnecessarily the petitioner is languishing in jail. Learned advocate for the State submits that chemical examiner's report has been obtained on 16.03.2026. Having regard to the fact that chemical examiner's report is already available, at this stage, I am not inclined to release the petitioner on bail. However, the petitioner would be at liberty to

approach this Court after the evidence of the seizure list witnesses are over.

Consequently, the prayer for bail of the petitioner in CRM(NDPS)589 of 2026 is dismissed.

Learned Special Court is directed to examine the seizure list witnesses within a period of 60 days from the next date so fixed. Report submitted by the State be kept with the record. All parties shall act on the server copy of this order duly downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of all requisite formalities.
