Leave is granted to the petitioner to correct the cause title of the writ petition since it is written 8respondent no.59 instead of 8respondent no.39. 2.

Affidavit-of-service, filed by the learned counsel for the petitioner in Court today, is taken on record. 3.

Heard the parties through their respective counsel. 4.

The petitioner in the instant case is a registered owner of Stage Carriage No.WB-41B-9032.

The main grievance of the petitioner is with regard to non-acceptance of the renewal fees for granting renewal of permanent Stage Carriage Permit of the petitioner.

Mr. Pantu Deb Roy, learned Additional Government Pleader appears for the State. He submits that the petitioner has to make an application in the prescribed format.

Learned counsel for the petitioner further submits that the petitioner has already made an application dated 18.3.2025 in writing for accepting the renewal fees for granting renewal of Permanent Stage Carriage Permit in terms of Section 81(2) of Motor Vehicles Act, 1988 read with Rule 148 of Motor Vehicle Rule, 1989. 8.

Learned counsel for the respondents does not make any objection to the same.

Having heard the parties the respondent no.3 is directed to consider the application dated 18.3.2025 with regard to the renewal of the permit upon payment of renewal fees as contemplated under the Motor Vehicles Act, 1988 within a period of 30 days from date in accordance with law.

10. It is made clear that upon consideration, if the petitioner is found to be entitled then the authority concerned shall forthwith accept the renewal fees and renew the permit to allow the petitioner to ply the vehicle.

11. Accordingly, the writ petition stands disposed of without expressing any opinion on the merits of the case.

12. There will be no order as to costs.
