Learned advocate representing NTPC Limited has placed before this Court a communication dated 27th January, 2026 issued by Deputy General Manager (HR) addressed to the learned advocate for NTPC Limited and same is taken on record.

On perusal of the said communication dated 27th January, 2026, it appears that it has been decided by the concerned authority of NTPC Limited to levy normal rent to the tune of ₹35,802/- in lieu of penal rent of ₹5,23,254/-. In the said communication gratuity, provident fund, NDCPS pension and SCSB pension are quantified and it has been decided by the authority that on completion of formalities those sums shall be paid to the petitioner.

However, it is also indicated in the said communication that there is an outstanding loan to
the tune of ₹1,05,487/- and same needs to be recovered.

Mr. Bihani, learned Senior Advocate representing the petitioner submits that perhaps ₹80,000/- has been paid towards outstanding loan.

In view of the communication dated 27th January, 2026, Court directs the concerned authority of NTPC Limited to release gratuity, provident fund, NDCPS pension and SCSB pension as quantified in the said communication dated 27th January, 2026, on completion of necessary formalities, by six (6) weeks from the date of communication of this order. 6.
Authorities of NTPC Limited are also directed to ascertain from the records whether payment has been made by the petitioner towards outstanding loan or not.

If it is found that some amount has been paid towards outstanding loan, adjusting the same, rest of the amount in connection with the outstanding loan is to be deducted from gratuity of the petitioner. 8.
With the aforesaid directions, writ petition stands disposed of.

Urgent photostat certified copy of the order, if applied for, be given to the parties upon usual undertakings.
