A queer prayer is couched in this writ petition for a direction upon the respondent authorities to remove respondent no. 8 who is working in the school as Political Science teacher since petitioner is also a teacher in Political Science in the same school. It is submitted that functioning of the petitioner as Assistant Teacher in Political Science in higher section is being disturbed due to presence of respondent no. 8.

However, nothing has been narrated as to how functioning of the petitioner is being affected due to presence of respondent no. 8. It is also submitted that since respondent no. 8 is working in the school as part-time

teacher he has no right to render service as an Assistant Teacher in the school.

However, on query being posed learned advocate for the petitioner has answered that petitioner is not the member of the Managing Committee of the concerned school.

Retention of respondent no. 8 as a parttime teacher is required to be decided by the Managing Committee of the school as well as State respondents. It is expected respondent authorities shall take steps accordingly with regard to retention of respondent no. 8 as parttime Political Science teacher in the school in question.

Concerned school authority is also directed to take necessary steps so that functioning of the petitioner as Political Science teacher in the school should not be affected due to presence of the respondent no. 8.

Writ petition stands disposed of, without any order as to costs.

Urgent photostat certified copy of this order, if applied for, be given to the parties on usual undertaking.
