The petitioner claims interest on delayed payment of terminal benefits.

The petitioner superannuated from service of the WBTCL on March 31, 2014. He received his terminal benefits of Rs.4,86,261/- towards provident fund on 25.07.2014 and Rs.2,95,363/- towards gratuity & leave encashment on 24.10.2014.

The petitioner is entitled to interest for the period from 01.04.2014 to 25.07.2014 at the rate of 6 per cent per annum towards provident fund and from 01.04.2014 to 24.10.2014 at the rate of 6 per cent per annum towards gratuity and leave

encashment. Let the same be paid to the petitioner by the WBTCL within a period of one month from date.

In default of payment as directed above, the rate of interest shall stand increased to 9 per cent per annum.

The writ petition is disposed of.

There will be no order as to costs.

All parties are directed to act on a server copy of this order duly downloaded from the official website of this Court.
