Learned Counsel appearing on behalf of the petitioner submits that although the matter was fixed for hearing under the heading "Specially Fixed", the application for restoration was not formally disposed of. He submits that the petitioner is in custody for 2 years because he could not furnish the surety of a Gazetted Officer although his statutory bail was allowed. Learned Counsel for the State submits that charge sheet has been submitted against the petitioner in the meantime. In view of the grounds taken in the application for restoration, the original revisional application is formally restored to its file and number. Accordingly, CRAN 2547 of 2019 is allowed.

Let this matter appear as a "Contested Application" on 15.12.2020.

The State is directed to produce the Case Diary on the next date.
