19.05.2023 Court No.35 Item No. 10 D.Hira CRR 912 of 2016 With CRAN 1 of 2016 (Old No. CRAN 1295 of 2016) With CRAN 2 of 2016 (Old No. CRAN 1772 of 2016) Uttam Kumar Patodia Vs.

The State of West Bengal & Ors.

Mr. Pravas Bhattacharya, Mr. M.F.A. Begg.

... for the State None appears on behalf of the petitioner. This matter is pending in the list since 04.05.2023 and has been called on each day of working of this Court since that date. In spite of that no one is appearing. The petitioner is found to be not interest in this case. Therefore, the same is taken up today for disposal on merit.

Petitioner has prayed for quashing of the impugned proceedings of G.R. Case No. 90 of 2011, now pending in the Court of Additional Chief Judicial Magistrate, Bidhannagar, arising out of East Bidhan Nagar Police Station Case No. 14 of 2011, dated 30.01.2011, under Sections 420/120B/406/421/471/468 of the Indian Penal Code (originally arising out of M.P. Case no. 73 of 2011, passed by an order dated 30.01.2011, passed by the Chief Judicial Magistrate, Barasat, under Section 156(3) of the Code of Criminal Procedure. His ground is that the FIR has not disclosed any cognizable offence against him.

On perusal of the entire materials available on record and the grounds made up by the petitioner I am constrained to find that the grounds thereof are not sufficient and cogent enough to warrant this Court's interference into the impugned order. Hence, in my considered

opinion the revision is liable to be dismissed. Criminal Revision being CRR 912 of 2016 is dismissed. All pending applications, if any, are consequently disposed of. Certified website copies of this order, if applied for, be supplied to the parties subject to compliance with all the requisite formalities. (Rai Chattopadhyay, J.)
