Mr. D. Barman Ms. Sanjukta Basu Mallick ... for the Petitioners This is an application seeking of an expeditious disposal of a proceeding in a complaint case under Sections 498A and 506 of the Indian Penal Code.

Learned counsel appearing on behalf of the petitioners submits as follows. The petitioners are the accused in this case. Although the petition of complaint was filed as far back as in 2009, till date the proceeding could not be concluded. It appears from the record that on 20.03.2012 the next date was fixed as 05.07.2012 for evidence. Yet, till date not a single witness has been examined. It is true that over the period of so many years on certain dates the accused too had to pray for adjournments. However, the proceeding has remained pending largely because adequate steps were not being taken by the complainant.

I have heard the submission of the learned counsel for the petitioners and have perused the revision petition. No prejudice would be caused to any one if a direction is passed for an expeditious disposal of the proceeding. It appears that an inordinate delay was occasioned in concluding the impugned proceeding. Regardless of whoever may be primarily responsible for the delay, the impugned proceeding ought to be expedited.

In view of the above and in the interest of justice, I request the learned Trial Court to conclude the proceeding as expeditiously as possible without granting any unnecessary adjournment to any of the parties, preferably within a period of one years from the next date of hearing.

With these observations, the revisional application is disposed of.
