Heard learned counsels for the parties.

Learned counsel for the petitioners submits that the private respondents who are the brothers of the 1st petitioner and claim to be co sharers of the property in question are restraining them from entering their house with the aid and assistance of local people. Complaint lodged by the petitioners in this regard before the police authority has not been acted upon.

Learned counsel for the State submits that the house in question is occupied by the brothers of the 1st petitioner. The petitioners have failed to provide relevant documents before the police authority in support of their claim. Also, four complaints lodged by the petitioners on identical issues have been registered as FIRs and charge sheets have been submitted upon completion of investigation.

Learned counsel submits that necessary steps shall be taken by the police authority to register the complaint lodged by the petitioner on 10th July, 2024.

The dispute between the parties is essentially civil in nature. The petitioners are at liberty to approach the appropriate civil forum for redressal of their grievance. In the meantime, the police shall keep strict vigil over the area in order to avoid any untoward incident and to ensure maintenance of peace and tranquility.

With the above observation and directions, the writ petition is disposed of.

There shall, however, be no order as to costs. Since no affidavit is invited, the allegations contained in the writ petition are deemed not to have been admitted. Urgent certified website copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
