The appeal is arising out of an order dated 25th February 2016 in connection with an application under Order 7 Rule 10 read with Section 151 of the Code of Civil Procedure.

Having regard to the fact that the suit property is situated Kokrajhar Town, District-Kokarajhar, Assam and the suit involves determination of right, title and interest in respect of the immovable property situated outside the jurisdiction of the City Civil Court, we are not inclined to interfere with the order passed by the Learned Trial Judge.

The appeal being FMA 2956 of 2016 stands dismissed.

In view of dismissal of the appeal, the connected application also stands dismissed.
