07.05.2025 Court No.28 Item No. 104 tbsr CRR 1467 of 2025 CRAN 1 of 2025 In the matter of: Bibek Kumar Das & Ors.

....Petitioners.

Ms. Swarnali Saha ....for the petitioners Ms. Rupsa Sreemani ....for the OP2 Mr. Arijit Ganguly Ms. S. Banerjee ....for the State Affidavit of service filed on behalf of the petitioners is taken on record.

Learned counsel appearing on behalf of the accused petitioners and the de facto complainant/victim submit that the disputes that had led to the registration of the present FIR have been finally settled between the private parties. In fact, the couple in question had a child on 26th January, 2025. They are staying together and they want the criminal proceedings to be quashed on the ground of compromise.

Learned counsel appearing on behalf of the State relies on report, which is taken on record. It appears that the de facto complainant/ victim had written to the Investigating Officer that she did not want to continue with the prosecution. According to her, a compromise has been arrived at between the private parties. There is no injury report present in the case diary.

In view of the settlement arrived at between the private parties in respect of the disputes that had led to the registration of the present FIR and in the interest of justice, I quash the impugned proceeding in ACGR Case No. 4352 of 2024 arising out of Haridevpur PS Case No. 455 dated 04.08.2024 on the ground of such settlement. The revision application and the connected application being CRAN 1 of 2025, accordingly, stand disposed of. Urgent Photostat certified copy of this order be supplied to the parties, if applied for, as early as possible. (Jay Sengupta, J.)
