The grievance of the petitioner is that the policy for reservation was not adhered to by the West Bengal Board of Primary Education in respect of the recruitment process initiated by the Board in the year 2020.
The petitioner claims to be an OBC-A category candidate as per his disclosure in the TET 2014 admit card.
Initially the petitioner did not qualify in the TET 2014 Examination. After awarding six extra marks in view of the wrong questions/answers, the petitioner qualified in the TET 2014 Examination. He was called for scrutiny/verification and interview. His name could
not be included in the State-wide merit list published by the Board on March 24, 2022 in respect of 738 vacancies as his total score i.e. 25.335 is less than that of the last merit listed candidate in his declared category i.e. OBC-A category which is 27.406.
Even as a physically handicapped category candidate his score is less than the score of the last merit listed candidate in the physically handicapped category which is 25.672.
As it appears that the petitioner scored marks less than the last merit listed candidate both in the OBC-A and the physically handicapped category, accordingly, the name of the petitioner could not be included in the merit list.
No relief can be granted to the petitioner in the instant writ petition.
The writ petition fails and is hereby dismissed. The instruction given by the Secretary, West Bengal Board of Primary Education to the learned advocate be retained with the records.
