SK Ct. 05 03.02.2022 W.P.A. No. 8321 of 2021 (Via Video Conference) Avik Ghosh & Ors.

Vs.

The State of West Bengal & Ors.

Mr. Shuvro P. Lahiri ... For the petitioners. Mr. Supriyo Chattopadhyay, Mr. Sabyasachi Mondal ... For the State respondents. Learned counsel appearing for the petitioners submits that the prayer of the 12 petitioners is for grant of proportionate Grade Pay commensurate with the prescribed Educational and Professional Qualifications under the 2009 Recruitment Rules. The petitioners are all Librarians in Higher Secondary Schools in West Bengal.

Upon hearing learned counsel, this Court is of the view that since the petitioners made a Representation on 2nd February, 2021 to various authorities for taking a decision, the writ petition may be disposed of by directing the respondent nos. 5, 6 and 7 to jointly consider the said Representation and pass a reasoned order upon hearing all concerned parties including the petitioners within a period of six weeks from the date of communication of this order.

Learned counsel appearing for the State suggests that respondent nos. 5, 6 and 7 are the proper

authorities who can consider and address the grievance raised by the petitioners.

The respondents shall be at liberty of constituting a committee if required for effective compliance of the direction passed by this Court. A copy of the reasoned order shall be made available to the petitioners within two weeks from the date of such reasoned order. W.P.A. 8321 of 2021 is disposed of with the above observations.

This order shall be made subject to the petitioners putting in the requisite Court Fees by tomorrow, i.e. on 4th February, 2022.

Urgent Photostat certified copy of this order, if applied for, be supplied to the parties subject to compliance with all requisite formalities.
