An application for bail under Section 438 of the Code of Criminal Procedure in connection with Burwan Police Station Case No.331 of 2015 dated 11.07.2015 under Sections 448/468/471/420/409 /120B of the Indian Penal Code and under Section 13 of the Prevention and Corruption Act.

The petitioners undertake to affirm and stamp the petition as per the Rules within 48 hours of resumption of normal functioning of the court. The petition is taken up through video conference on the basis of such undertaking. The petitioners claim that the charges against the petitioners remain for academic purpose only since the petitioners have repaid the amount claimed by the Indian Bank.

The State corroborates the position by referring to a letter issued by the Indian Bank, Siuli Branch on October 19, 2020.

In view of the bank's letter, there may not be any need to take the petitioners into custody at this stage as long as they cooperate with the investigation and report to the investigating officer as and when called till the investigation is completed.

In the event of arrest, the petitioners will be enlarged on bail upon furnishing a security of Rs.10,000/- (Rupees Ten Thousand Only) each, with two sureties of like amount each, one of whom must be local, to the satisfaction of the arresting officer. The petitioners will also abide by the conditions laid down in Section 438(2) of the Code of Criminal Procedure, 1973.

CRM 4283 of 2020 along with CRAN 1 of 2020, CRAN 2 of 2020, CRAN 3 of 2020 and CRAN 4 of 2020 filed therein stand disposed of.

The original letter dated October 19, 2020 be retained with the records.
