1. Despite direction for filing of affidavit-in-opposition by order dated 15th September 2008, no such affidavit-inopposition is found on the record. It, also, appears that despite direction dated 1st March 2024, the respondents failed to produce the records of the case.
2. It is rather unfortunate that no steps have been taken by the respondents to defend the case.
3. In view thereof, I direct the respondent no. 5 to submit an explanation by way of an affidavit as to why the respondents are not interested to defend the case and also the reasons for non-production of the records, as directed by order dated 1st March 2024.
4. Such affidavit shall be filed on or before the matter is taken up next.
5. List this matter on 13th May 2024.
6. The respondents shall ensure that the records are produced on the returnable date.
