Learned counsel appearing on behalf of the petitioners submits as follows. The petitioner no.1 is the mother in law and the petitioner nos. 2 to 4 are the cousin brothers in law of the victim deceased. The petitioner nos. 2 to 4 stayed about five kilometers away from the residence of the prime accused and the victim. Even the petitioner no.1 resided separately as she was working as a domestic help at some place. The husband who was the prime accused was arrested and was in custody for about two months and is on bail now. Learned counsel appearing on behalf of the State relies on the case diary and submits as follows. The post mortem report clearly indicates that it was the case of suicide. There are statements of neighbours which only say that there used to be some discord in the matrimonial house of the victim. Charge sheet has already been submitted.
Considering the statements of witnesses and the materials on record and the fact that charge sheet has been submitted, I am inclined to allow the application.
In the event of arrest, the petitioners shall be released on bail upon furnishing a bond of Rs.10,000/- each with two sureties of like amount each, one of whom must be local, to the satisfaction of the Arresting Officer and also be subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure, 1973 corresponding to Section 482(2) of the BNSS, 2023 and on further condition that the petitioners shall not try to influence the witnesses or threaten them.
The application for anticipatory bail is, thus, allowed. (Jay Sengupta, J.)
