Petitioner has prayed for transfer order which would permit her to continue to discharge duty as primary teacher in the present school where she has been transferred vide two transfer orders dated 17th November, 2023 and 28th October, 2024 for a period of one year each.

It is submitted on behalf of the petitioner since twice petitioner has been transferred for a period of one year each and such period of transfer is going to expire on 30th April, 2025 requiring another transfer order to be passed by the concerned authority of District Primary School Council, Bankura which would enable her to continue to discharge duty as primary teacher in the present school.

An application has been made seeking issuance of necessary transfer order which is at page 31 of the writ petition.

District Primary School Council, Bankura and State respondents are represented by learned advocates.

It is submitted by the District Primary School Council, Bankura that in the event direction is given upon the Chairman, decision to be taken in accordance with law.

Having considered the submissions made on behalf of the parties, the writ petition stands disposed of directing Chairman, District Primary School Council, Bankura being respondent no.3 to decide the application for transfer which is at page 31 of the writ petition by seven days from date and the decision to be taken by the Chairman shall be communicated to the petitioner immediately thereafter.

However, it is made clear that suspension of Utsashree portal shall not be a ground for rejecting the transfer application of the petitioner.

Urgent photostat certified copy of this order, if applied for, be given to the parties on usual undertaking.
